Village of Oswego Village Board met July 6.

Here is the minutes provided by the Board:

1. Call to Order

Chairman Pajor called the Oswego Planning & Zoning Commission Meeting to order at 7:00 p.m.

Chairman Pajor announced that the recording and sound system in the boardroom is under construction and unavailable for use at this meeting. Chairman Pajor stated two handheld recorders are being used and requested those wishing to speak to please speak clearly and loudly.

2. Roll Call

Present: Dominick Cirone, Ken Holmstrom, Rick Kuhn, Charles Pajor, Rebecca Stine

Absent: Amanda Purkeypile

There was a quorum.

3. Minutes

4. Public Hearings

Delta Sonic Car Wash

Southeast corner of Route 34 & Kendall Point Drive

Applicant: Delta Sonic Car Wash Systems, LLC

James Boglioli was sworn in

Delta Sonic Car Wash Systems Inc.

Director of Development

Buffalo, New York

Mr. Boglioli is the attorney representing Delta Sonic.

Using an exhibit, Mr. Boglioli presented an overview of the project stating the facility will include the following proposed uses:

• A convenience store

• Car wash and detail shop

• Automobile service shop

• Gas pumps and gas island

• Restaurant

• Vacuum stations

Mr. Boglioli discussed the proposed access onto Route 34 and Kendall Point Drive using an exhibit.

Mr. Boglioli stated a traffic study was submitted on the proposed development. The average vehicles per day that will visit the facility are anticipated to be approximately 500 vehicles during a weekday and 900 vehicles on a weekend. The majority of the vehicles will enter and exit the facility along Route 34 to the north.

Mr. Boglioli stated the following hours of operation:

• The car wash and detail shop will operate from 7:00 a.m. until 9:00 p.m. Monday through Saturday and 8:00 a.m. until 7:00 p.m. on Sunday.

• The convenience store/gas station will be open Monday through Friday from 5:30 a.m. until 10:00 p.m., Saturday 6:00 a.m. until 10:00 p.m. and Sunday 7:00 a.m. until 10:00 p.m.

Mr. Boglioli commented that the Zoning Code requires 17 parking spaces for the car wash, 29 for the service station, 44 for the retail store, and 5 for the restaurant use within the store for a total of 95 spaces. The plan provides 101 parking spaces, exceeding the minimum requirement.

Mr. Boglioli used a community noise assessment exhibit showing the sound level decibels to the residential property. Mr. Boglioli stated that they have over 25 car washes and they know exactly what produces noise. From the neighbor’s yards, they are below the Village’s noise ordinance. The Village allows for 60 decibels during the day and 55 decibels at night at the property line of residential property. The sound map shows a sound level of 57.7 decibels at the residential property line.

Mr. Boglioli stated the developer has agreed to meet the Village’s landscaping requirements and would install a 6 foot board on board fence along the south border of the site.

Mr. Boglioli discussed the building elevations stating the building would not be like typical commercial buildings. The entire building is brick and glass.

Michael Werthmann was sworn in

KLOA Inc.

Mr. Werthmann is the traffic engineer with KLOA Inc. that produced the traffic study report for the proposed Delta Sonic development.

Mr. Werthmann stated uses other than a car wash would generate more traffic such as a grocery store site. Car washes and gas stations typically draw customers from existing traffic during morning and evening peak hours.

Michael Green was sworn in

Buffalo, New York

Mr. Green stated he is the vice-president of construction for Delta Sonic.

Mr. Green gave an overview of the ventilation system, the “greenhouse “system and solar panels for the south side.

Mr. Boglioli used an exhibit to show Commissioners the left hand turns. Discussion was held on the turning right-in/right-outs.

Mr. Green stated that Route 34 is under IDOT jurisdiction and they will have to meet IDOT standards. There will be a 6 inch median that you can’t drive over. There will also be signage and striping.

Audience Comments:

Cora Lienert was sworn in Steeplechase Oswego, Illinois

Ms. Lienert stated she lives in Steeplechase and is the Chairperson of the Village Community Committee and the community has a lot of concerns regarding Delta Sonic:

• An increase in traffic – total number of cars entering and leaving the site

• Cars making U-turns on Kendall Point Drive at the intersection of Route 34 and entrance to Steeplechase

• Backup of traffic at the other entrances on Route 34 to enter Delta Sonic

• Hours of operation and will they change and extend to midnight or 24 hours

• Selling of diesel fuel and large diesel trucks having access to the site

• Type of restaurant going into the site

• Noise concerns – would like noise abatement panels to help reduce the light, noise and pollution

• Glare from lights and hours lights would be left on

• Air quality and pollution from gas, exhaust and other toxic chemicals that may be used to maintain cars

• Plans for building on the other side of Kendall Point Drive and how this would impact Kendall Point and Steeplechase

Ms. Lienert stated the Village needs more than another car wash, gas station, oil change and detailing shop.

Tony Monico was sworn in

Steeplechase

Oswego, Illinois

Mr. Monico expressed concerns regarding property values in Steeplechase. He would like to see appealing landscaping entering into the community.

Carol Latina was sworn in

Steeplechase

Oswego, Illinois

Ms. Latina stated concerns regarding increase in traffic and how this will impact the residents of Steeplechase.

Ms. Latina referred to the 2014 market analysis findings and how the Village decided a Delta Sonic car wash and gas station would be a preferred choice for Oswego citizens and consumers stating there are plenty of these services on the Route 34 corridor.

Ms. Latina expressed concern of locating a Delta Sonic in such close proximity to an established residential neighborhood. Ms. Latina stated that since it is the mission of the Village to responsibly grow out the community in a way that meets the quality of life expectations of its citizens, and how does the Village reconcile the incompatibility of a 55 and older community with a Delta Sonic.

Ms. Latina also expressed concerns about property values being impacted and security.

Ms. Latina asked what standards were being met for the special use request and the compliance for code for signage.

Ms. Latina inquired about liquor licensing and what types of liquor would be sold and will liquor be sold through the drive thru.

Ms. Latina asked what type of designation Kendall Point has in the Village’s transportation plan.

Ms. Latina discussed buffering the area with solid closed fencing.

Ms. Latina urged Commissioners and Village Board to visit the proposed site and drive Kendall Point Drive from Route 34 through Steeplechase to Yoakum Boulevard for the purpose of evaluating the advisability of this development.

Ms. Latina stated that she researched other Delta Sonics in the Chicagoland area and most of them have access on major or minor arterial streets and there are no other Delta Sonic facilities that have an entrance or exist into residential area.

Barbara Secor was sworn in Steeplechase Oswego, Illinois

Ms. Secor stated that she agrees with all the comments made by Ms. Latina.

Ms. Secor said that there is no other Oswego car wash facility where you turn into a subdivision to get into a car wash. Colleen Schmidt was sworn in

Steeplechase

Oswego, Illinois

Ms. Schmidt expressed concerns regarding an increase in traffic, crime, noise, and safety in the area.

Ms. Schmidt stated she is opposed to the left turn into Steeplechase.

No additional audience members wished to speak at the public hearing.

Director Zenner reviewed the Planning & Zoning Commission process stating the first step is that a project comes before the Planning & Zoning Commission for review. The Commission’s recommendations are advisory only and are forwarded on to the Village Board for consideration.

Director Zenner stated that engineering approval is required before the project goes before the Village Board. The Village Board makes the final decision. Director Zenner if anyone wants to provide their contact information Community Development will advise them when the project goes before the Village Board.

Commissioners Comments:

Commissioner Cirone asked for clarification on the number of cars visiting the car wash during a weekday during peak time. Mr. Boglioli responded 500 cars during peak time weekdays.

Commissioner Cirone asked about liquor licensing. Director Zenner responded that this is a Village Board decision and not the Planning & Zoning Commission decision.

Mr. Boglioli discussed the board on board fencing stating it is a solid six foot high fence that allows no sound or light.

Director Zenner discussed the landscaping stating that staff recommended adding evergreen material along the southern line on the Delta Sonic side. Mr. Boglioli stated they will comply with the Village landscaping code and will meet every requirement.

Director Zenner responded to the lighting standards stating the light poles will be 20 feet in height and have flat lenses so the blubs will not be visible.

Mr. Werthmann responded to the concern regarding why this site was chosen stating as demonstrated by the traffic study the project would not adversely affect traffic conditions. Mr. Werthmann stated the property is zoned for commercial use and was zoned for this use when Steeplechase was developed.

Mr. Werthmann stated that a 50,000 square foot grocery store on this site would generate much higher volumes of traffic. Mr. Boglioli reviewed the hours of operation stating the opening and closing times as presented in his initial overview of the project.

Discussion was held of the number of cars that could be stacked at one time. Mr. Werthmann stated over a 100 cars in four lanes can be stacked at one time.

Mr. Green stated the approximate time for cars to get through the car wash is typically 2 to 2 1⁄2 minutes. If 100 cars were stacked waiting time would be approximately 20 minutes. Mr. Green stated that stacking never goes into the road. The facility is fully manned to keep entrances and exits from being blocked. Mr. Green stated he does not see any problems with stacking at this location. Timing of the traffic signal was discussed.

Using an exhibit discussion was held on the design of the access drives.

Mr. Boglioli responded to the concern regarding the property on the other side of Kendall Point Drive stated that property is owned by a sister company and at this time no activity is planned for this site.

Director Zenner responded to the concern regarding the special use permit stating the standards for the special use request are listed in his staff report that was made available to Commissioners and audience members.

Commissioner Kuhn discussed the use of speed bumps. Director Zenner replied that usually speed bumps don’t really slow drivers down since they slow down for the speed bump and then speed up upon crossing the speed bump.

Mr. Boglioli stated they will monitor the traffic concerns at this location.

Recommendation:

Motion: Commissioner Holmstrom, second Commissioner Cirone to accept the findings of fact and approval of the Preliminary and Final P.U.D. and Special Use Permit for an automobile laundry subject to revising the landscape plan to meet the number of plantings required per the Code, installation of a fence along the southern property line, working with Staff to relocate landscaping as necessary to the southern property line to provide additional buffering, and to provide further study to limit the left turn on Kendall Point side from the site

Prairie Market Lot 1

Applicant: Richport Property, LLC

Project Manager: Tyler Grace

Director Zenner presented the staff report stating that the applicant is requesting approval of a Final P.U.D. to allow for a one-story 7,500 square foot multi-tenant retail building on a 0.93 vacant outlot parcel in the Prairie Market development.

The building will contain mostly brick on all four sides. The elevations are consistent with the Prairie Market P.U.D.

Director Zenner discussed the required landscaping plan and stated the plan does not currently meet the diversity requirements found in the Zoning Ordinance. Staff will work with the applicant to provide a final landscape plan prior to Village Board review.

Director Zenner reviewed the parking space requirements and stated the applicant is providing fifty one (51) spaces. The Zoning Code requires thirty eight (38) spaces. The current plan does not provide for bicycle parking. Staff will work with the petitioner to ensure bicycle parking is included in the final plan.

Recommendation:

Motion: Commissioner Stine, second Commissioner Kuhn accept the findings of fact and recommend approval of the Final P.U.D. to allow for the development of a multi-tenant retail building at Prairie Market Lot 1 Interior Outlot, located at the southwest corner of Route 34 and Fifth Street subject to the following conditions:

1. Submit a final landscaping plan prior to Village Board consideration

2. Submit final engineering plans prior to Village Board consideration

3. Include required bicycle parking
