Mr. Jackson stated the petition is being requested to be tabled by the applicant until the October Plan Commission meeting.

Mr. Jackson gave the Planning staff report.
Mr. John Philipchuck, 111 E. Jefferson Avenue, Naperville, IL, appeared on behalf of the petition. Mr. Philipchuck gave further background information about the project.
Commissioner Broderick asked if the station is for trucks only or all vehicles. Mr. Philipchuck said there is a separate area for trucks so it is for all vehicles.
Commissioner Orlando asked if Joliet Street will be in back of the facility. Mr. Philipchuck said it will not go through because they are asking for it to be vacated.
Mr. Andrew Clements, 110 Rachel Avenue, said his property borders the land in question. Mr. Clements stated his concerns over the semis being parked 24/7, and the water drainage and flooding.
Commissioner Fiday commented that this is a tier 1 area of concern for semi-trucks. She went there to see how the traffic was and sat there for 45 minutes and stated there were 40 semis back to back. She does see a need for a gas station to be there but also sees the problems and concerns.
Mr. Chris Kalischefski, Corporate Design Development Group, Hoffman Estates, also appeared on behalf of the petition and said they are the site architects for Speedway. Mr. Kalischefski responded to the concerns of Mr. Clements.
Commissioner Orlando asked about Lot #2. Mr. Kalischefski said that will remain in Speedway's ownership until an appropriate party would like to buy it. There was further discussion regarding Lot 2.
There were some concerns from a few of the Commissioners on moving forward with the project at this meeting due to more questions. Other Commissioners felt it would not be good to delay it. Mr. Philipchuck and Mr. Kalischefski responded to the Commissioners.

Mr. Jackson appeared on behalf of the petition.
Commissioner Cox asked if the purpose is to not maintain the road anymore. Mr. Jackson responded.
Mr. William Zaffino, 515 Richards Street, appeared before the Commission. Mr. Zaffino stated his opposition to the petition for many reasons because it will affect his business on Richards Street. Mr. Zaffino said the City has not maintained the street for many years other than filling a few potholes.
Mrs. Peggy Zaffino appeared before the Commission. Mrs. Zaffino said they were not aware of any problem until 5 years ago someone lowered the weight from 30 tons to 15 tons on the bridge. They hired a lawyer and now they are here in front of the Plan Commission. She asked that it be tabled because the bank that they have a loan with may want to be present as well. This vacation will take away their right to have a business by not having any water, electric or heat.
Mr. Jackson said the vacation would not be for any utilities. Those would remain and there is a requirement that an easement be placed over those utilities to remain in the future.
Ms. Elizabeth Banken, Attorney from 1733 Park Street in Naperville, appeared on behalf of Mr. & Mrs. Zaffino. Ms. Banken said it is her understanding that the City approached IDOT with the concept of an additional curb cut. Now there is a pending law suit about this that was filed in May on behalf of the Zaffino's. Ms. Banken said the curb cut issue is extremely significant in this matter. Her clients have no interest in buying a 100 year old bridge and trying to maintain that any more than the City of Joliet wants to. If the curb cut could be put in there would be access to their property and that should be explored. She is asking that the Plan Commission seriously consider tabling this issue until there is a response from IDOT. They are expected to receive response by September 28. Ms. Banken also had concerns about Joliet's notice process.
Mr. Michael Veugeler, 501 S. Richards Street, in Will County, appeared before the Commission. He would like time to get representation from his attorney. He received a notice on Monday about the meeting and did not have adequate time to be prepared. He stated his concerns about the lowered weight limit on the bridge.
Reverend Gaines Hamilton, representing St. James Church, said he has land facing Richards Street and he wanted to know if any of this would affect his land because they plan on building a church there. Mr. Jackson responded that this matter would not impact his church property.
Commissioner Cox said to replace the bridge would be a significant cost.
