A. Building & Zoning Report
Dir. VanKerkhoff noted the development team continued to work successfully remotely. VanKerkhoff reported building inspections continue for review of complaints and new construction sites. No additional questions from the committee.
B. Zoning Petitions
1. PETITION NO. 4566: Ruben Hernandez
VanKerkhoff used a visual aid to discuss the petition and gave a brief description of staff recommendations. Further discussion continued from the committee.
The petitioner has requested a re-zoning from F-District Farming to B-3 District Business with Special Use for a Truck Terminal. The ZBA recommended approval with two stipulations no access to Route 30 and all right of way concerns shall be coordinated with the Village of Montgomery.

Dir. VanKerkhoff used a visual presentation to discuss the petition. VanKerkhoff reported this as a petition to allow further development of an open space for the adoption resource center, Anderson Animal Shelter. VanKerkhoff acknowledged the presence of an Anderson Animal Shelter representative for any questions if needed. Further discussion occurred from the committee. Member Wojnicki stated her support and excitement for this petition in her District 15. VanKerkhoff noted in regard to future petitions discussions for revisions to the language were in process with the state’s attorney’s office to make the path for approvals more clear in the future.
The petitioner has requested a re-zoning from F-District Farming to PUD this would allow a planned unit development for an animal shelter, veterinary clinic, horse and wildlife rescue. Dir. Wollnik reviewed stipulation No. 2 in regard to the storm water detention requirement. The ZBA recommended approval with the four stipulations. The petitioner was available for questions.

Dir. VanKerkhoff used a visual aid to briefly discuss the petition. The petitioner has requested a re-zoning from F-District Farming to F-1 District Rural Residential to allow an existing home to be sold off from the remaining property proposed open space. The ZBA recommended approval.

Chair Martin reported the request to place this item on the agenda from Member Iqbal. Dir. VanKerkhoff discussed the decision to allow or prohibit adult use cannabis businesses in Kane County acknowledging the presence of asst. state’s attorney Brady to any answer questions. VanKerkhoff reported in 2019 all local governments had the opportunity to allow or prohibit adult use cannabis businesses. Previous voting attempts were negative with ability to revisit as the ordinance included language for inclusion and amendments for 90 days.
VanKerkhoff briefly discussed the state use guidelines, businesses types allowed and the all or nothing methodology not allowing states to pick and choose. VanKerkhoff used a visual presentation to display the kind of businesses among other things that can be added to the ordinance. VanKerkhoff shared what Kane County’s neighboring counties are doing.
D. Ordinance: Rescinding Ordinance No. 19-415 and Permitting Cannabis Business Establishments within the Unincorporated Areas of the County of Kane

A. Morningstar Community Church Subdivision
Staff Orlik reported the subdivision Morningstar is in the southern portion of Kane County. Orlik used a visual presentation to report the location and gave a brief description of the parcel. Orlik reported staff recommend approval.

Staff Orlik reported on the land/cash report for FY20. Orlik reported this ordinance has been in place for 2 months and is working well with positive feedback from schools and parks. Orlik requested the committee continue to remain on task for any forthcoming issues.

A. Ordinance: An Ordinance Establishing the Church-Monitor Special Service Area (Or Special Service Area No. SW-52) of Kane County, Illinois and the Levy of Taxes for the Purpose of Paying the Cost of Providing Special Services in and for Such Area.
Dir. Wollnik reported no objections were received in the 90 days after the public hearing. Wollnik acknowledged this would be scheduled for fall construction.
