Kendall County Children’s Advocacy Center Board met Nov. 17.

Here are the minutes provided by the board:

I. Call to order

II. Roll call- Present in person: Eric Weis, Jason Bastin, James Jensen, Michelle Meyer, Phillip Smith, Jonathan Whowell, Mitch Hattan, Michael Enu-Enwosu, Brenda Karales

III. Approval of Agenda: Motion to approve agenda by Phillip Smith, seconded Jonathan Whowell, motion carried unanimously

IV. Approval of Minutes from November 10, 2020 meeting: Motion to approve minutes by Jonathan Whowell, seconded by Jason Bastin, motion carried unanimously

V. Old business

a) 2021 statistics to date: The 2021 statistics to date was passed out and discussed. Brenda indicated we have just complete 114 interviews to date. Last year at this time we 61 interviews and in 2019 we did 97 interviews.

b) Discussion and evaluation of the implementation and effectiveness of the protocol was held (required under law on an annual basis). No changes were suggested or required

c) Proposal, if any, of appropriate modifications to the protocol to maximize its effectiveness were none

d) What Law Enforcement Needs to Know About Forensic Interviewers Presenting Evidence during Forensic Interviews. Brenda discussed that our interviewers are trained at presenting evidence to victims during a VSI and indicated with cases such as child pornography, that specific requirements are needed to show the victim the evidence. Brenda informed that she changed the intake form to include whether there may be some evidence to show and requires the detective that is handling the case to watch the presentation on how. Phillip Smith indicated it might be a good idea to make the detectives who come to the CAC do a yearly review of the presentation. Brenda indicated that she will share the link to the Board to handle per their department.

e) Statutory amendments effective January 1, 2020

1) 5 ILCS 140/7.5 (FOIA)

2) 55 ILCS 80/4.5 (Forensic interviews; electronic recordings) It was discussed that the police agency should not give out the CAC interviews pursuant to FOIA or subpoena without discussing it with their department’s attorney or with the State’s Attorney’s Office. Protective orders need to be in place for any subpoena.

f) Other- none

VI. New business

a) Approval of 2022 meeting schedule for CAC Advisory Board

November 16, 2022 at 11:30 a.m. in SAO. Motion to approve the 2022 annual meeting by Phillip Smith, seconded by James Jensen, Motion carried unanimously

b) Other - None

VII. Next meeting: November 16, 2022 at 11:30 a.m.

VIII. Adjournment- Motion to adjourn by Michelle Meyer, seconded by Phillip Smith. Motion carried unanimously.
