1. CALL TO ORDER

Chairman Pajor called the Oswego Planning & Zoning Commission Special Meeting to order at 7:02 p.m.

2. ROLL CALL

Present: Dominick Cirone, Jason Kapus, Rick Kuhn, Andrew McCallum, Charlie Pajor, Judy Sollinger

Absent: None

There was a quorum.

Oswego community representatives in attendance were:

3. MINUTES

Motion: Commissioner Sollinger, second Commissioner Kuhn to accept the minutes of the November 10, 2022 Planning & Zoning Commission Meeting.

Ayes: Commissioners Cirone, Kapus, Kuhn, McCallum, Pajor, Sollinger

4. PUBLIC HEARINGS

Special Use

Catalyst Cannabis of Oswego

Applicant: EEL-Illinois, LLC

Project #1156.22

Project Manager: Rod Zenner

Motion: Commissioner Sollinger, second Commissioner Cirone to open the Public Hearing at 7:03 p.m.

Ayes: Commissioners Cirone, Kapus, Kuhn, McCallum, Pajor, Sollinger

Nays: None

Director Zenner stated the petitioner is requesting approval of a Special Use Permit to allow for a cannabis dispensing facility, Catalyst Cannabis of Oswego, at 260 N. Merchants Drive. Director Zenner stated the property is a former day care center and the building has been vacant for several years. Director Zenner stated the existing building has sustained some water damage and would require extensive rehab for the building to meet the Code requirements for a commercial retail use. Director Zenner stated the petitioner is proposing to remove the outdoor play area located on the west side of the building to provide 44 parking spaces on the site.

Director Zenner stated the State and Village Code states that dispensary facilities cannot be within 1,500 feet of another facility, and the Planning and Zoning Commission recently recommended approval of a facility located at 2420 Route 30, which is within 1,500 feet of this proposed facility. Director Zenner stated both applications will be brought before the Village Board for review and consideration to grant approval of one of the applications.

Lee Fry was sworn in Oak Brook, IL

Mr. Fry, the petitioner, stated the proposed Oswego facility will be operated by Catalyst Cannabis, the largest cannabis retailer in California. Mr. Fry stated the building will have extensive remodeling, and the lobby will accommodate 12 customers. Mr. Fry stated a security firm will provide on-site security, and lighting will be added on the building and in the parking lot. Mr. Fry stated deliveries will occur at the rear of the building in a restricted access area.

No additional audience members wished to speak at the public hearing.

Motion: Commissioner Sollinger, second Commissioner Kuhn to close the Public Hearing at 7:16 p.m.

The Commission discussed the proximity of residential uses to the north and west.

Recommendation:

Motion: Commissioner Sollinger, second Commissioner Cirone to accept the findings of fact for the Standards for a Special Use Permit and recommends approval of the Special Use Permit for a cannabis dispensing facility for the location at 260 N. Merchants Drive.

Ayes: Commissioners Cirone, Kapus, McCallum, Pajor, Sollinger

Text Amendment

Unified Development Ordinance

Chairman Pajor stated the November 10, 2022 Public Hearing for this agenda item was continued to this meeting and CMAP staff Jake Seid and Jared Patton remain sworn in.

The Commission, Director Zenner, and CMAP staff reviewed the first seven sections of the UDO, and discussed the following in greater detail:

• The UDO limiting the use of Planned Unit Developments to allow permitted uses/developments to occur if they met the criteria in the Code.

• Final plats of subdivision not requiring Planning & Zoning Commission review.

• The Administrative Adjustment process, allowing staff to approve minor deviations from a select number of zoning requirements.

• The appeal process and identifying the scope of what entities have the right to appeal.

• Automatic expiration of an approved Preliminary PUD if a Final PUD has not been approved within two years.

• Subdivision block length, and mid-block pedestrian access being owned and maintained by the homeowner’s association.

• Appropriate street and right-of-way widths.

The Commission suggested some changes to the wording of the draft UDO to provide clarity to the text. The Village Attorney suggested that the appeal process be limited to the petitioner and the notified neighbors.

Recommendation:

Motion: Commissioner Kuhn, second Commissioner Sollinger to continue the Public Hearing to the December 15, 2022 Planning & Zoning Commission Special Meeting.

Ayes: Commissioners Cirone, Kapus, Kuhn, McCallum, Pajor, Sollinger
