City of Plano City Council met April 8.

Here are the minutes provided by the council:

The regular meeting of the Plano City Council was called to order on Monday, April 8, 2024, at 6:00 p.m., by Deputy Clerk Carin Martin in the Council Room at City Hall. The Deputy Clerk led the Pledge of Allegiance to the Flag.

MINUTES:

A motion was made by Alderman Nadeau, seconded by Alderman Fawver, to approve the minutes of the regular meeting on March 25, 2024. A unanimous “Aye” voice vote was heard. The motion passed.

AGENDA:

A motion was made by Alderman Williams, seconded by Alderman Nadeau, to approve the agenda for the regular meeting of April 8, 2024. A unanimous “Aye” voice vote was heard. The motion passed.

WARRANTS:

A motion was made by Alderman Wickens, seconded by Alderman Fawver, to accept the report of the Finance Committee and that orders are drawn on the Treasury to pay per warrant list dated March 26, 2024 in the amount of $135,611.07.

INTRODUCTION OF GUESTS:

Guests and members of the press were welcomed by Mayor Pro-Tem Mulliner.

Michael Welz from the Plano Community Garden requested the City of Plano’s help with their 2024 community garden. He asked for the City to provide water, tilling, and refuge pickup. He thanked Karl Tisberger for his hard work and he really appreciates all his help in the past. One objective this year is a butterfly project with Scouts. Mayor Pro-Tem Mulliner said this garden donated 8,000 pounds to the Food Pantry last year.

MAYOR’S REPORT: Mayor Pro-Tem Mulliner

A motion was made by Alderman Nadeau, seconded by Alderman Johns, to waive the raffle license fee for the Plano IL Rotary Club for their fundraising event. They will be selling raffle tickets through July 7, 2024. Alderman Nadeau stated this is a yearly fundraiser. They are having a 5B’s BBQ dinner on May 7, 2024, at the Plano Molding parking lot. They will be selling 50/50 raffle tickets through July 7, 2024. On July 7th, they will announce the winner at the parade. These funds go to the two scholarships the Rotary Club awards.

A motion was made by Alderman Nadeau, seconded by Alderman Johns, to waive the special event liquor license fees for St. Mary’s fundraising event on May 4, 2024. Alderman Nadeau said St. Mary’s yearly sends youth to a national retreat. St. Mary’s pays to bus and house these youth at this retreat. This fundraiser is family friendly and for a non-profit organization. Alderman Johns asked if he could vote since he has grandchildren attending St. Mary’s. Attorney Thomas said it was okay for him to vote.

A motion was made by Alderman Williams, seconded by Alderman Fawver, to confirm hiring by the Police Commission of Sonya Petzold as a full time Police Officer, at a salary of $67,802.15, effective April 9, 2024, and authorize the Mayor to sign the certificate of hire.

Attorney Thomas swore in the New Officer Petzold.

A motion was made by Alderman Williams, seconded by Alderman Fawver, to confirm hiring by the Police Commission of Colin Quill as a full time Police Officer, at a salary of $67,802.15, effective April 9, 2024, and authorize the Mayor to sign the certificate of hire. Alderman Johns asked if the Police Department is fully staffed now. Interim Chief Allison said they are at 25 of 26 positions filled.

CITY ADMINISTRATOR’S REPORT: Martin Shanahan Jr.

City Administrator Shanahan shared a brief perspective of annexations and rezoning. He said many communities spend six plus months from start to finish on this process. He stated that Plano’s staff and Plan Commission members have spent just over two months to process the ones on tonight’s City Council agenda. CITY ATTORNEY’S REPORT: William Thomas

Ordinance #2024-07: An ordinance authorizing the execution of an annexation agreement (Henning Family Farm LLC).

A motion was made by Alderman Williams, seconded by Alderman Nadeau, to authorize the execution of an annexation agreement (Henning Family Farm LLC). Attorney Thomas said each property has an ordinance authorizing an annexation agreement, an annexation ordinance, and an ordinance to rezone from A-1 Agriculture to Plano M-2 General Manufacturing. These properties are contingent upon each other. Alderman Johns asked if rezoning these properties falls in the Comprehensive Plan. Mayor Pro-Tem Mulliner said yes. Mayor Pro-Tem Mulliner asked if a 20-year agreement is normal. Attorney Thomas said yes. Alderman Nadeau asked what happens at the end of the 20-year agreement, if the annexing would continue or not. Attorney Thomas said these annexations will become part of the City boundaries before the 20 years is over. He said that time frame is per statutes, and a lot of this is formality before adding property to corporate boundaries.

Alderman Wickens asked why does the City want these properties annexed. City Administrator Shanahan said these are within the Comprehensive Plan boundaries. Alderman Wickens asked if the City needs all these properties. Jeff Sobotka said these property owners collectively decided to annex their properties within the corporate boundaries, and to rezone them consistent with the City’s Comprehensive Plan. Alderman Wickens asked what the City will gain by doing this. Mayor Pro-Tem Mulliner said property taxes and prestige with a good industrial park and being a good partner.

Ordinance #2024-16: An ordinance amending the Municipal Electric Utility Tax Ordinance A motion was made by Alderman Williams, seconded by Alderman Nadeau, to amend the Municipal Electric Utility Tax Ordinance. Attorney Thomas said City Administrator Marty Shanahan put together a memo to go with this ordinance. Alderman Nadeau said no one wants to raise rates but it is needed to be current and not leave money on the table. Marty gave an example of someone using 899 kilowatts a month, at a cost of $135.00 a month, this increase would add 41 cents to the bill.

Ordinance #2024-17: An ordinance to increase the number of Class G-1 liquor licenses from 5 to 6 (Just Jackpots Gaming Café.)

A motion was made by Alderman Nadeau, seconded by Alderman Wickens, to approve an ordinance amending Title 3 Chapter 2 Section 3-2-7 of the Code of Ordinances of the City of Plano Number of Class G-1 liquor licenses. Alderman Wickens asked where is this going to be located. Mayor Pro-Tem Mulliner said in the former Shelby’s gaming location. Alderman Nadeau said this would help by not leaving an empty storefront, and it is in a previous gaming location. Alderman Johns asked what the hours of operation would be. Owner Jerry Piaskowy gave the days and hours the business would be open. Alderman Williams asked if they were putting a moratorium on gaming cafes. Mayor Pro-Tem Mulliner said it has been brought up before. There were questions about legal hours to be open, which are set in our code of ordinances. Also, about the number of licenses available. Alderman Nadeau and Mayor Pro-Tem Mulliner said that there are no open licenses. The number we have are for open businesses. Once a liquor licensed business closes, that license is rescinded and the number of that class of liquor license is decreased.

Mayor Pro-Tem Mulliner commented that the first part of the three annexations are critical to Plano. He said it follows the Comprehensive Plan and will continue to make Plano a better place to live.

Resolution #2024-04: A resolution to enter into an agreement with Teska Associates, Inc. to update the Comprehensive Plan

A motion was made by Alderman Fawver, seconded by Alderman Nadeau, to approve and authorize the execution of an agreement for a Comprehensive Plan update between the City of Plano and Teska Associates, Inc.

Resolution #2024-05: A resolution to approve the Façade Improvement Program update A motion was made by Alderman Fawver, seconded by Alderman Nadeau, to adopt an updated policy on the Façade Improvement Program for the City of Plano. Mayor Pro-Tem Mulliner said this is a really good move to beautify downtown and help encourage businesses to apply with double the grant money that could be awarded. He said the committee did an excellent job on this update. Alderman Nadeau said she is really proud to be part of the Community Development committee, who did a lot of tweaking on this so that more businesses will hopefully take advantage of this application. She thanked City Administrator Shanahan for his work.

The final draft of the FY ’25 Original Budget is available for review. A public hearing and approval of the ordinance for the FY ’25 Budget will be an agenda item at the April 22, 2024 Council meeting. POLICE CHIEF’S REPORT: Norm Allison

Interim Chief Allison thanked the Council for their help with getting the two new Police Officers sworn in tonight.

PUBLIC WORKS REPORT: D. Boyer-absent, J. Beyer-absent, K. Tisberger

Karl said that residents are able to put out unlimited kraft leaf bags during the Spring clean-up. The leaf vacuum will not be out picking up leaves until the Fall.

DIRECTOR OF BUILDING, PLANNING & ZONING’S REPORT: Jeff Sobotka-nothing

COMMITTEE REPORTS:

ADMINISTRATIVE/HEALTH & SAFETY: Alderman Mulliner-nothing

BUILDINGS, GROUNDS AND ZONING: Alderman Williams

Alderman Williams said this committee finished reviewing the solar ordinance. They are waiting to hear feedback about it.

COMMUNITY DEVELOPMENT: Alderman Fawver-nothing

FINANCE: Alderman Wickens

Alderman Wickens called a meeting for April 22, 2024 at 5:15 p.m.

PARKS: Alderman Johns

Alderman Johns gave an update on some of the city parks.

A motion was made by Alderman Johns, seconded by Alderman Nadeau, to approve GTZ Maintenance for the 2024 Mowing, Weed Control, and Fertilizing, in the amount of $12,500.00. Alderman Johns said this is a $500.00 increase from last year.

Alderman Nadeau expressed her thanks for the approval of the non-profit fundraisers earlier tonight. She said those who will be turning in special event requests should remember to give plenty of lead time to turn in their applications for approval. Mayor Pro-Tem Mulliner thanked Alderman Nadeau for all she does.

CITIZENS’ COMMENTS:

Nicole Diaz thanked the Council for working diligently with the Eldamain project. She said the Façade Improvement update is great for Main Street.
