City of Plano City Council met Sept. 9.

Here are the minutes provided by the council:

The regular meeting of the Plano City Council was called to order on Monday, September 9, 2024, at 6:01 p.m., by Mayor Michael Rennels in the Council Room at City Hall. Mayor Rennels led the Pledge of Allegiance to the Flag.

MINUTES:

A motion was made by Alderman Williams, seconded by Alderman Swoboda, to approve the minutes of the regular meeting on August 26, 2024. A unanimous “Aye” voice vote was heard. The motion passed. AGENDA:

A motion was made by Alderman Williams, seconded by Alderman Johns, to approve the agenda for the regular meeting of September 9, 2024. A unanimous “Aye” voice vote was heard. The motion passed. WARRANTS:

A motion was made by Alderman Wickens, seconded by Alderman DeBolt, to accept the report of the Finance Committee and that orders are drawn on the Treasury to pay per warrant list dated August 27, 2024 in the amount of $147,294.53.

A motion was made by Alderman Wickens, seconded by Alderman Fawver, to accept the report of the Finance Committee and that orders are drawn on the Treasury to pay per warrant list dated August 28, 2024 in the amount of $1,856.40.

A motion was made by Alderman Wickens, seconded by Alderman DeBolt, to accept the report of the Finance Committee and that orders are drawn on the Treasury to pay per warrant list dated August 30, 2024 in the amount of $200.00.

WAGE REPORT:

A motion was made by Alderman Wickens, seconded by Alderman Fawver, to accept the report of the Finance Committee and that orders are drawn on the Treasury to pay the wage report dated August 2024 in the amount of $529,465.14.

Guests and members of the press were welcomed by Mayor Rennels.

CITIZENS’ COMMENTS:

Michael Welz from The Plano Community Garden expressed his thanks for the continued support for The Plano Community Garden.

MAYOR’S REPORT: Mayor Rennels

A motion was made by Alderman Williams, seconded by Alderman Swoboda, to approve the Mayor’s appointment of Dawn Honrud to the Aurora Area Convention & Visitors Bureau board. She will be replacing Mary Kay Sergo.

Motion passed.

A motion was made by Alderman Fawver, seconded by Alderman Swoboda, to act on the recommendation of the Administrative, Health, & Safety committee for the revocation of The Massage Spa’s massage license. Alderman Fawver previously stated his opinion to vote no on this issue. He said revocation went too quickly. He remarked that they are only considering the license violation, and suspension is better in this incident.

Alderman DeBolt seconded what Alderman Fawver said.

Alderman Johns is in line with Aldermen Fawver and DeBolt. He said the revocation is too harsh.

Alderman Wickens is voting yes because of what she heard during the public hearing at the Administrative, Health, and Safety meeting. She feels Ms. Xiao contradicted herself. Alderman Williams is a member of the Administrative, Health, and Safety committee, and is in favor of the nay votes. He recommends a license suspension.

Alderman Swoboda said this issue shed light on how to do things for hearings and not as committee meetings. The minutes from the public hearing were summarized and not verbatim. The Council may need to look at the system on how to do these hearings if riffs are going to be created.

Alderman Wickens wonders why the Administrative, Health, and Safety committee heard all of the information if the rest of the Aldermen are not going to listen to them. Alderman Fawver said the 2.5-hour meeting was condensed into 1 page of notes and the evidence presented was not given to them.

Motion was defeated.

A motion was made by Alderman Fawver, seconded by Alderman Johns, to suspend The Massage Spa’s massage license for 30 days, impose a $1000.00 fine, and reinstating the license is based on the completion of the list of items to correct and the fine being paid. The fine amount was amended to $750.00 per Alderman Fawver.

Alderman Wickens asked who would follow up to make sure corrections were made and rules are being followed. Mayor Rennels said it would be the Police Department and code enforcement. Attorney Thomas said City Code 3-11-11, Massage Establishments, the penalties of violation shall be subject to a fine between $250.00-750.00. Alderman Fawver amended the motion to a fine of $750.00. Alderman Wickens asked if another violation occurs, will this license be revoked or go through a hearing and the Council again. Mayor Rennels said it would be the same process but the Council may not be as lenient.

CITY ADMINISTRATOR’S REPORT: Martin Shanahan Jr.

City Administrator Shanahan congratulated Dawn Honrud on her appointment to the Aurora Area Convention & Visitors Bureau board. He reported that HR Green is working on an application through the IL Transportation Enhancement Program for additional funds for the Main Street Project. This will be an agenda item for the next Council meeting.

CITY ATTORNEY’S REPORT: William Thomas

Ordinance #2024-30: Approve an ordinance to decrease the number of Class B liquor licenses A motion was made by Alderman Fawver, seconded by Alderman DeBolt, to approve an ordinance amending Title 3 Chapter 2 Section 3-2-7 of the Code of Ordinances of the City of Plano decreasing the number of Class B liquor licenses from 4 to 3 (Holmes & Holmes, Inc. d/b/a The Vineyard). Roll Call:

Ordinance #2024-31: Approve an ordinance to increase the number of Class B liquor licenses A motion was made by Alderman Fawver, seconded by Alderman Mulliner, to approve an ordinance amending Title 3 Chapter 2 Section 3-2-7 of the Code of Ordinances of the City of Plano increasing the number of Class B liquor licenses from 3 to 4 (Shiv Mudra Inc. d/b/a Vineyard Liquors).

Resolution #2024-21: Approve a resolution for an agreement with Team REIL, Inc. for work with playground equipment

A motion was made by Alderman Williams, seconded by Alderman DeBolt, to approve a resolution approving and authorizing the execution of an agreement by and between the City of Plano and Team REIL, Inc. to remove, transport, and install playground equipment in an amount not to exceed $34,048.00. This will be at a location to be determined. Alderman Johns said the workers will make notes of worn/broken parts/pieces, get pricing to replace parts, remove cement on the posts, etc.

CITY CLERK’S REPORT: Carin Martin, Deputy Clerk

Sales and related taxes for June 2024 are in the amount of $238,926.16.

The current unobligated MFT balance for June 2024 is in the amount of $1,532,415.94. CITY TREASURER’S REPORT: Zoila Gomez-nothing

POLICE CHIEF’S REPORT: Norm Allison

Chief Allison said Sgt. Beery is CPR certified, and can certify personnel at the Police Department in CPR. He will work with City Administrator Shanahan to provide this training to city staff and department heads. PUBLIC WORKS REPORT: D. Boyer-absent, J. Beyer-absent, K. Tisberger

Karl said the paving is done and striping started today on the streets. There is a pre-construction sidewalk meeting this week. The Creek Road Bridge project started in August, with 9% completed in the design stage.

DIRECTOR OF BUILDING, PLANNING & ZONING’S REPORT: Jeff Sobotka-absent

COMMITTEE REPORTS:

ADMINISTRATIVE/HEALTH & SAFETY: Alderman Mulliner

Alderman Mulliner will be calling a meeting soon.

BUILDINGS, GROUNDS AND ZONING: Alderman Williams

Alderman Williams has a meeting scheduled for September 24, 2024 at 6:00 p.m.

COMMUNITY DEVELOPMENT: Alderman Fawver

Alderman Fawver has a meeting scheduled for September 24, 2024 at 6:30 p.m.

FINANCE: Alderman Wickens

Alderman Wickens called a meeting for September 23, 2024 at 5:15 p.m.

PARKS: Alderman Johns

Alderman Johns said the decorated book benches’ paint is chipping. He will be working on getting it fixed. He has been in contact with a potential Eagle Scout about his gaga ball pit project. He expressed histhanks for voting in favor of the playground equipment resolution tonight. This committee has a meeting scheduled for September 17, 2024 at 9:30 a.m.

PERSONNEL & INSURANCE: Alderman Swoboda

Alderman Swoboda said this committee met on August 27, 2024 and heard a presentation from IMIC regarding how insurance pools work, etc.

SPECIAL EVENTS: Alderman Nadeau-absent

Mayor Rennels said there is a Hispanic Heritage event on September 14, 2024.

STREETS & UTILITIES: Alderman DeBolt

Alderman DeBolt called a meeting for September 17, 2024 at 6:00 p.m.

CITIZENS’ COMMENTS:

Keith Riddle spoke about The Massage Spa massage license issue. He said it has been a long, extremely unfair journey for Lily because the ordinance needs to be fixed. He feels the 30-day license suspension was not defined in the ordinance, is harsh, and is concerned she may lose her business because of going a month without an income. He said Lily has already remedied all the issues she is supposed to take care of. He would like for the Council to correct the inadequacies in the ordinances surrounding businesses.

Neal Veen thanked the Council for their work on passing the playground resolution tonight and all the research they did for it. He said they will make a lot of kids happy.

A motion was made by Alderman DeBolt, seconded by Alderman Williams, to adjourn. A unanimous “Aye” voice vote was heard. The motion passed. The meeting adjourned at 6:47 p.m.
