State Representative Jed Davis has introduced legislation aimed at ensuring parents have the ultimate authority in deciding whether their children should be prescribed psychotropic medications. The proposed House Bill 2512 mandates that doctors provide parents with printed FDA Medication Guides before prescribing such drugs to minors. Additionally, it requires that parents give written, informed consent prior to any prescription being issued.
Representative Davis emphasized the importance of parental involvement in medical decisions for their children. "Parents – not bureaucrats – should be making medical decisions for their kids," he stated. "Informed consent is critical, especially when we’re talking about powerful medications with potentially serious, life-altering side effects."
The bill also introduces a new online system for parents to report adverse drug reactions, aiming to enhance accountability and transparency. Noncompliance with these regulations could result in penalties, including potential Medicaid reimbursement suspensions for providers and financial consequences for the Department if reporting requirements are not met.
Furthermore, the Department of Healthcare and Family Services will be required to compile quarterly reports on adverse drug reactions and submit them to the legislature.
