President Gail Johnson called the meeting to order at 7:12 p.m. and led the Pledge of Allegiance to the Flag of the United States of America.

Public Hearing:
E.1. Public Hearing to Comply With Truth in Taxation Act 35 ILCS 200/18-60, 18-65.
a. 2017 Tax Levy for the Village of Oswego
The Public Hearing was opened at 7:19 p.m.
Administrator Di Santo addressed the Board regarding the options for this year’s tax levy. Each year the Village goes through the expenses and determines the levy as required by State law. The goal is to have enough money to fund the tax levy. The Village of Oswego has one of the lowest property tax rates in the State of Illinois at 1.48% of the total tax. For a home value of $250,000, the tax paid to the Village would be approximately $128.00; of which 100% of that tax goes to the Police Fund. Option A keeps the tax rate flat and enough money to fund as required by law. This will result in an approximate increase of $6.00 for the year. Option B provides for an increase to fund the entire Police pension contribution. This will result in an approximate increase of $12.50 for the year.

b. Special Service Area SS60 Oswego 04-SSA-01
The Public Hearing was opened at 7:24 p.m.
In 2001, the Village of Oswego approved the annexation of the Estates of Fox Chase development. The development never established a Homeowner’s Association. The subdivision has responsibilities for maintaining the detention ponds that were originally assigned to the HOA in addition to common areas that are the responsibility of the homeowner’s association. Specifically, the large detention pond along the west side of Gates Creek Drive and the landscape berm along Mill Road. The Village contacted all the property owners in the Estates of Fox Chase Unit 2 and Unit 3 to inform them of the necessity to activate the Special Service Areas that was established when the subdivision was created back in June of this year. The Village is activating the Special Service Areas to provide funding for the necessary and minimal maintenance work to maintain the detention pond, common areas and mowing of the berm. Quotes have been obtained by the Public Works department to provide for this maintenance and the special service area levies will provide the amount needed to complete the work.
Unit 2 – Landscape Berm and Detention Pond-
SSA is required to install and maintain required landscaping on the berm along Mill Road and to maintain the detention pond west of Gates Creek Drive. This SSA applies to the Estates of Fox Chase single-family homes, and the estimated tax per improved lot is between $200-300 in the next year, and less than $200 in subsequent years when additional homes are constructed.
Unit 3 – Detention Pond-
SSA is required to maintain the detention pond to the west of Gates Creek Drive and applies to the townhomes west of the ponds. The estimated tax per residence is less than $100 which will fund the necessary maintenance required in the next year.

Staff Reports:
Administrator Di Santo
December meeting schedule- looking at dropping to one meeting on Monday, December 11th. It will be held as a special meeting and may be the only meeting December.
Director Cole-
Christmas Walk & Tree Lighting financials- received pledges from sponsors; received in-kind services and donations; cash pledges promised. Total of all is around $14,000+. Huge impact on holiday cheer. The Grinch might be coming to the tree lighting. Jewel/Osco is sponsoring this year’s event. The Board previously asked staff to make events sustainable. Last year’s expenses with goods and services was around $18,500. This has been a team effort. Board member congratulated staff.
Director Horton-
Sales Tax audit- notices that some businesses and vendors are not charging the 8.5% sales tax; much less the additional 1% food and beverage tax. Staff spoke to the IL Department of Revenue (IDOR) and was told that even if the business or vendor isn’t charging the correct tax, they are still paying it. Staff met with Azavar, a municipal audit service, in the hopes of them assisting the Village with the auditing of books and comparing the numbers to IDOR’s books. A section was added to the business registration renewals as a reminder of the sales tax rates. Businesses and vendors are still liable to pay the tax. Staff will know soon who is paying the food and beverage tax. Staff will remind them of the tax. The Village has seen sales tax inconsistencies. A new State law requires the Village to pay 2% to the State for them to administer the Village’s taxes.
Director Hughes-
Salt- last March a bid was put out for the purchasing of salt. Morton Salt was awarded the bid at $48.88 per ton. Last year the Village paid $65.75 per ton. This is the lowest price in the past 10 years. Staff cut the order this year to 1,200 tons. The Village still has a lot of salt in storage.

Director Horton addressed the Board regarding the property tax levy abatement ordinances. The annual tax levies for all of the Village’s outstanding bond issues is abated each year. Sales tax revenues, motor fuel tax revenue and water/sewer revenues are used to make the debt service payments each year. The Village will abate the levies already on file with the County Clerks. Abating does not tax the residents because the Village has the funds to pay the bonds instead of levying them as property taxes. The total amount to be abated for the 2011, 2012, 2013, 2014, 2016 and 2017 Debt Issues is $4,262,125. Every year these are abated.

K.4. Resolution Authorizing the Execution of a Contract with Layne Christensen Company for Maintenance and Repairs to Well #10 in the Amount Not to Exceed $150,000.00. Resolution No. 17-R-96
Director Hughes addressed the Board regarding the contract with Layne Christensen Company for maintenance and repairs to Well #10. Based on the pumping history and current performance to date, it is anticipated that the maintenance project will cost $135,000.00; providing there are no major mechanical defects found with the pumping equipment. The preventive maintenance can prevent an untimely failure at peak water usage and allow the scheduling of the pulling of well equipment at off peak times when demand is lower. In the event repairs exceed the budgeted dollar amount, staff will bring the additional repair items back to the Village Board for approval. The contract is exempt from competitive bids since Layne Christensen is the only authorized service agent to work on the pumps. Layne Christensen has been the Village’s contractor since the 1950’s. There was no further discussion.

Oswego Fire Local #4773 is coordinating a relief effort to assist the 24 families that were displaced by a fire that occurred at 1500 Light Road on November 6, 2017. They are only accepting gift cards and monetary donations. Drop off donations to Oswego Fire Station #1 located at 3511 Woolley Rd. between 7:00 a.m.-4:00 p.m. Monday through Friday. The Red Cross and the Kendall County Health Department are also assisting the families. Please keep the families in your thoughts.
Small cell wireless- Representatives opposed the bill, but the bill still passed the House today; AT&T has asked that the State allow them to put poles and antennas wherever they want; they are ugly line of sight items that they can stick on street lights by your homes; municipalities would like to be able to tell them no; AT&T has done this before; they are taking away our local control; Administrator Di Santo and President Johnson attended a press conference yesterday where they spoke out against this bill; the bill is now in the Senate; Senator Oberweis is one of the sponsors; call your Senator tomorrow and let them know you are opposed to the bill; the Village has spent money in burying unsightly wires; Chairman for three Counties, along with many Mayors, spoke yesterday opposing this bill; there is a need for local control on this issue.
Oswego Fine Arts Department- Oswego high School is holding an exhibition tomorrow at 7:00 p.m.; 54 high schools were invited; President Johnson will be doing the keynote; celebrate the arts.
Trustee Reports:
Trustee West- thanked President Johnson for the Proclamation to the Veterans. Collection for Toys for Tots is this month; drop off toys at the Police Department.
