City of Joliet Zoning Board of Appeals met June 18.

Here is the minutes provided by the board:

1. CALL TO ORDER:

PRESENT: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb.

ABSENT: None.

3. APPROVAL OF MINUTES: APPROVAL OF MAY 21, 2020 ZONING BOARD OF APPEALS MINUTES.

There was a comment regarding a revision petition 2020-20 (1900 Essington Road) meeting minutes. Staff stated the meeting minutes will be revised to reflect the change mentioned.

Motion to Approve MAY 21, 2020 ZONING BOARD OF APPEALS MINUTES with the exception of 2020-20 (1900 Essington Road) that will be reviewed at the July meeting was made by Mr. Bob Nachtrieb.

Motion seconded by Mr. Vincent Alessio. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.

4. CITIZENS TO BE HEARD ON AGENDA ITEMS: NOTE: There is a new temporary procedure for public speaking. Details can be found on the Joliet.gov "Meeting Agendas, Minutes, & Videos" web page. In-person public speaking is temporarily suspended. This section is for anyone wanting to speak regarding items listed on the agenda, except for items listed under Public Hearing. Anyone speaking on an agenda item is entitled to speak for a maximum of 4 minutes. It is not a question and answer period and staff and the Zoning Board of Appeals do not generally respond to public comments. Please note speakers who engage in conduct injurious to the harmony of the Zoning Board of Appeals shall be called to order by the Presiding Officer and may forfeit the opportunity to speak.

5. OLD BUSINESS: PUBLIC HEARING

a. PETITION 2019-18: An Extension of a Special Use Permit to allow auto tire installation & repair as part of a proposed tires sales facility, located at 2526 W. Jefferson Street.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore in Mr. Christopher Enright, who represents the petitioner. Mr. Enright stated building permits will be applied for late Summer 2020.

Motion to Approve PETITION 2019-18: An Extension of a Special Use Permit to allow auto tire installation & repair as part of a proposed tires sales facility, located at 2526 W. Jefferson Street was made by Mr. Vincent Alessio.

Motion seconded by Mr. Charles McCauley. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.

6. OLD BUSINESS: NO PUBLIC HEARING

7. NEW BUSINESS: PUBLIC HEARING

a. PETITION 2020-21: A Variation to allow two main buildings on one lot and a Variation of required off-street parking, located at 1590 N. Larkin Avenue.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore in the architect for the project.

Chairman Hennessy had a question regarding the proposed project and proposed and future tenants.

Motion to Approve PETITION 2020-21: A Variation to allow two main buildings on one lot and a Variation of required off-street parking, located at 1590 N. Larkin Avenue was made by Mr. Bob Nachtrieb.

Motion seconded by Mr. Vincent Alessio. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.

b. PETITION 2020-22: A Variation of a minimum required rear yard setback from 25' to 21'-11" in order to allow the construction of a covered deck, located at 3207 Tina Circle.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore property owner, Mr. Ryan Tague, New Lenox, Illinois. He briefly described the proposed project.

Mr. Nachtrieb questioned if the petition has approval from the immediate neighbor for the proposed project. Mr. Tague stated the neighbor does not object to the proposed project.

Motion to Approve PETITION 2020-22: A Variation of a minimum required rear yard setback from 25' to 21'-11" in order to allow the construction of a covered deck, located at 3207 Tina Circle was made by Mr. Vincent Alessio.

Motion seconded by Mr. Bob Nachtrieb. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.

c. PETITION 2020-23: An Amendment to a Variation of Use (Ord. No. 7912) to expand the previously permitted use (automobile service garage) to include light truck repair/maintenance and commercial tire wholesale sales, B-3 (General Business) use, in an R-2 (Single-Family Residential) zoning district, located at 1101 N. Broadway Street. **Petition has been withdrawn**

c. PETITION 2020-24: A Special Use Permit for an auto repair shop (light truck repair/maintenance) located at 1101 N. Broadway Street. **Petition has been withdrawn**

d. PETITION 2020-25: A series of Variations to allow construction of two single family houses on two undersized lots that are in common ownership, located at 1113-1115 Cutter Avenue.

Mr. Kendall Jackson stated there is an issue with calling up the petition at this time. Chairman Hennessy suggested to proceed with the petition. Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy questioned the anti-monotony ordinance and Mr. Jackson explained the ordinance.

Please note the petitioner is not present.

Mr. Nachtrieb questioned if any type of construction would be allowed without the need for variation requests by the property owner. Mr. Kendall Jackson responded.

Motion to Approve PETITION 2020-25: A series of Variations to allow construction of two single family houses on two undersized lots that are in common ownership, located at 1113-1115 Cutter Avenue was made by Mr. Bob Nachtrieb.

Motion seconded by Mr. Vincent Alessio. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.

e. PETITION 2020-26: A Variation to allow a tractor-trailer parking and storage area, located at 3350 Channahon Road.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore in attorney, Mr. Michael Hansen, Joliet, Illinois, who represents the petition. Mr. Hansen stated there has been discussion with Staff regarding payment for the pilot payment-in-lieu program. There was a brief discussion regarding the proposed project and what will be allowed if approved. Mr. Hansen requested this petition be tabled; however, he then withdrew his request and opted to contact his client to clarify a few questions.

Mr. Hansen returned to the podium for further discussion. Mr. Hansen returned to the meeting and stated everything has been clarified and requested the Board continue with a vote. (27:37)

Motion seconded by Mr. Bob Nachtrieb. 

Motion carried by the following vote: 

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Charles McCauley, Ms. Collette Safford, Mr. Vincent Alessio, Mr. Bob Nachtrieb. 

NAYS: None.
