City of Joliet Zoning Board of Appeals met Aug. 20.

Here is the minutes provided by the board:

Pursuant to Phase 4 of the Restore Illinois Plan, the Illinois Department of Commerce & Economic Opportunity's Guidelines recommend best practices that limit an in-person meeting to 50 people or less (Council Chambers allows for 18 members of the public) while adhering to social distancing guidelines. During meetings, any member of the public physically present in the Council Chambers in excess of the limit will be asked to wait in another room with live feed to the meeting until the Citizens To Be Heard on Agenda Items section or Public Comments section of the meeting.

Pursuant to the Illinois Department of Commerce & Economic Opportunity's Guidelines, it is recommended that any individual appearing in-person wear a face-covering to cover their nose and mouth.

Citizens who are unable to attend the meeting can email comments in advance of the meeting to publiccomment@joliet.gov.

3. APPROVAL OF MINUTES: APPROVAL OF July 16, 2020 ZONING BOARD OF APPEALS MINUTES.

Motion to Approve July 16, 2020 ZONING BOARD OF APPEALS MINUTES was made by Mr. Bob Nachtrieb.

Motion seconded by Mr. Vincent Alessio. 

Motion carried by the following vote:

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Vincent Alessio, Mr. Bob Nachtrieb, Ms. Colette Safford.

NAYS: None.

4. CITIZENS TO BE HEARD ON AGENDA ITEMS: NOTE: There is a new temporary procedure for public speaking. Details can be found on the Joliet.gov “Public Comments” web page.

This section is for anyone wanting to speak regarding items listed on the agenda. Anyone speaking on an agenda item is entitled to speak for a maximum of 4 minutes. It is not a question and answer period and staff and the Zoning Board of Appeals does not generally respond to public comments. Please note speakers who engage in conduct injurious to the harmony of the Zoning Board of Appeals shall be called to order by the Presiding Officer and may forfeit the opportunity to speak.

a. PETITION 2020-28: A Variation of Use to continue a mixed use (commercial and residential) building in an I-2 (General Industrial) Zoning District and a Special Use Permit to allow an office use in an I- 2 (General Industrial) Zoning District, located at 742-744 Collins Street. (NOTE: The Special Use Permit application has been withdrawn from this petition)

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy stated there is no time limit stated in the staff report. Mr. Jackson responded the Memorandum of Understanding with Neighborhood Services outlines a time frame.

Chairman Hennessy swore in Ms. Leticia Carrillo, 3219 Pioneer Court, Joliet, Illinois, who appeared on behalf of the petition.

Mr. Nachtrieb thanked the new for coming the City to apply for the request since the property had been in violation.

Motion to Approve PETITION 2020-28: A Variation of Use to continue a mixed use (commercial and residential) building in an I-2 (General Industrial) Zoning District and a Special Use Permit to allow an office use in an I-2 (General Industrial) Zoning District, located at 742-744 Collins Street. (NOTE: The Special Use Permit application has been withdrawn from this petition) subject to conditions mentioned in staff report was made by Mr. Vincent Alessio.

Motion seconded by Mr. Jim Riggs. Motion carried by the following vote:

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Vincent Alessio, Mr. Bob Nachtrieb, Ms. Colette Safford.

NAYS: None.

b. PETITION 2020-29: A Variation from the City’s Non-Residential Design Standards (Section 47-15H) to permit metal siding on the exterior of the existing commercial condominium building, located at 2621 City’s Edge Drive.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore in attorney, Mr. Michael Hansen, Joliet, Illinois, who appeared on behalf of the petition. Mr. Hansen stated the photos were shown are old photos of the building and do not show the current siding on the building. Mr. Hansen stated the cost to bring the building up to City code is cost prohibitive considering the location of the property.

Mr. Nachtrieb questioned the current condition of the building specifically the paint on the exterior of the building. Mr. Jason Briscoe, Briscoe Financial LLC, indicated which photo in the slideshow depicts the current condition of the building. Mr. Briscoe stated the hardy board siding that was on the building has been removed and currently has a pre-finished metal type siding. The pre-finished metal type siding was original to the construction of the building.

Mr. Alessio stated he conducted a site visit of the property and the photo with the new siding is somewhat representative of what he observed during his site visit.

Mr. Briscoe explained the costs related to replacing the hardy board or stucco.

Mr. Hansen stated he conducted a site visit approximately a month and the building was in the condition that it is today, with the pre- finished metal siding. Mr. Hansen stated the does not understand why photos of the failed hardy board were shown in the slide show. He stated this petition may have to be delayed on month. Chairman Hennessy stated if the building is painted that will resolve the issue. Mr. Hansen responded there is no need to paint the building. Mr. Hansen stated his client is willing to paint if needed.

Mr. Alessio stated the petition is contingent upon the siding being painted. Mr. Kendall Jackson explained the petition is for the metal siding to remain.

Chairman Hennessy swore in Mr. Mike German, 26053 W. Lauren Drive, Channahon Drive, who was one of the original owners of the property and is in favor of the variation request. He explained the reason for the metal and hardy board siding. He currently has two units and stated if $60,000 is invested into the property he will lose a tenant. He stated he does not understand the reasoning if hardy board would need to be replaced.

Chairman Hennessy asked if the property with the building has always been in City of Joliet limits. Mr. Kendall Jackson stated this commercial business park was built in Joliet. Chairman Hennessy asked how and why this petition is needed. Mr. Jackson stated the City of Joliet design standards were in place when this building was constructed but unsure why it was constructed with metal siding when the design standards specified it should be hardy board or masonry. Therefore, it was required that hardy board be placed over the metal after the building was constructed. Mr. Alessio needed clarification regarding the variation request.

Mr. German stated the process when the building was constructed and the request for the siding. Chairman Hennessy stated his opinion.

Ms. Safford requested clarification the upcoming comment will be in favor of the petition.

Chairman Hennessy swore in Mr. Glen Lawson, 25137 W. Pawnee Lane, Channahon, Illinois, who is in favor of the petition. He stated he is a current tenant. He stated that he is favor with the current condition of the property which includes the metal siding and parking lot improvements that have been made.

Chairman Hennessy swore in Ms. Angie VanDyke, 22548 S. River Road, Shorewood, Illinois, who appeared in favor of the petition. She is a current tenant and stated the cost for the siding improvement would cause a hardship.

Chairman Hennessy swore in Mr. Ken Minor, 22911 S. Francis Way, Channahon, Illinois. He is the owner of adjacent lots to this site. He stated he is a developer in the area. Mr. Minor stated if this is granted and the new standard then it should apply to all new developments in the area. Chairman Hennessy stated this variation is specific to this site only and the overall design standards still apply to future developments.

Chairman Hennessy swore in attorney Mr. Bryan Wellner, 822 Infantry Drive, Joliet, Illinois, who appeared in opposition of the petition. He stated this variation request would not meet the criteria to grant this variation request per the zoning ordinance. He stated by granting the variation request it would change the character of the location. He stated the other building comply with the design standards and the site in question that does not comply with the design standards. HIs client, Mr. Minor, would like to comply with code with future developments in the area but the granting of this request would alter the characteristic of the business park.

Mr. Hansen responded to Mr. Wellner's comments.

Chairman Hennessy reminded the Board of the variation request.

Mr. Nachtrieb requested clarification regarding the variation request. Mr. Jackson responded a condition should be added to include the siding be painted or maintained in a fashion that does not detract from the subdivision. Mr. Nachtrieb stated there are visible stains on the current siding. Mr. Hansen stated he is willing to work with staff to make proper improvements. Mr. Briscoe stated there are areas that need power washing which will be done. Mr. Jackson stated the condition regarding the condition of the siding allows city staff to enforce to future condition of the siding.

Motion to Approve PETITION 2020-29: A Variation from the City’s Non-Residential Design Standards (Section 47-15H) to permit metal siding on the exterior of the existing commercial condominium building, located at 2621 City’s Edge Drive subject to the added condition that the siding be power washed or painted as needed was made by Mr. Jim Riggs.

Motion seconded by Mr. Bob Nachtrieb.

Motion carried by the following vote:

AYES: Mr. Ed Hennessy, Mr. Jim Riggs, Mr. Vincent Alessio, Mr. Bob Nachtrieb, Ms. Colette Safford.

NAYS: None.

c. PETITION 2020-30: A series of Variations to reduce the rear yard setback from 3 ft. to 1.2 ft. and the side yard setback from 3 ft. to 1.2 ft. to allow the reconstruction of a garage on an existing concrete slab, located at 417 Landau Avenue.

Mr. Kendall Jackson read the staff report into the record.

Chairman Hennessy swore in Mr. Francisco Ortiz, 417 Landau Avenue, Joliet, Il, who appeared on behalf of the petition. He explained the proposed project.

Mr. Nachtrieb questioned if the majority of the houses in this area were constructed near the property lines. Mr. Jackson responded that is correct. Mr. Jackson stated the majority of the detached garages are in close proximity of the property lines.

Chairman Hennessy swore in Mr. David Holt, 654 E. Jackson Street, Joliet, Il, who appeared in favor of the petition. He stated this area has garages are not 3' from the property lines and this request should be granted.
